Allegations of False Reporting, False Mental Health Claims, and Malicious Intent
I, Armen Festekjian, affirm under the pains and penalties of perjury that the following is true to the best of my personal knowledge.
I request that the Court consider issuing criminal complaints arising from false statements that I believe were intentionally provided to law enforcement following a physical altercation between myself and my brothers, Aram Festekjian and Alek Festekjian.
On the day of the incident, Aram and I were discussing religion and witchcraft. During that discussion I told Aram that I believed he had demonstrated jealousy toward my relationship with Grace on three separate occasions during recent telephone and FaceTime conversations.
After I made that statement, Aram approached me aggressively, came within an inch of my face, and stood directly over me. He is much taller than me. Fearing that he was about to strike me, I reacted by wrapping my arms around his midsection in a defensive bear hug. I did not punch, kick, slap, scratch, or strike him. He remained standing throughout this initial contact.
As I attempted to restrain him, Aram threw punches and struck me in the upper body and my head. I then turned my body and restrained him from behind in an effort to prevent further blows to my face. My purpose was defensive and was to stop additional strikes.
Alek was not present when the confrontation began. He entered only after the struggle had already progressed. After Alek entered the room, when I was holding Aram from behind, I released Aram because I believed the immediate danger had ended. Despite my releasing Aram, Alek then physically intervened.
Following the incident, police became involved.Based upon statements later made by my brothers, provably and materially false information was provided to law enforcement concerning what occurred. In particular, Alek falsely represented that he had witnessed the entire encounter from beginning to end, despite not being present when the confrontation initially occurred.
False statements were made minimizing or denying my injuries. For example, Alek reiterated over and over that there was no blood or injury. During the police response, however, Lieutenant Palmer observed blood on my neck and arm and asked whether I required medical treatment or supplies to address the injuries.I believe these statements materially misrepresented the incident and portrayed me as the aggressor despite my account that I acted defensively after Aram approached me aggressively and struck me.
The subsequent reports resulted in significant consequences, including my hospitalization. Because my brothers were aware of the serious consequences that police intervention and hospitalization could have, I believe the accuracy and good faith of their statements should be carefully investigated.
I respectfully request that law enforcement and the Court investigate whether knowingly false statements were provided to police or investigators concerning this incident and whether any criminal statutes relating to false reporting, false statements, or obstruction of justice may have been violated.I understand that the determination of whether criminal charges are appropriate rests with the investigating authorities and the Court.
I allege that Aram Festekjian and Alek Festekjian provided false and materially misleading information to law enforcement following a physical altercation between us. I further allege that they made false statements concerning my mental health that contributed to governmental action against me, including my hospitalization.
Not every false statement necessarily had to be made knowingly. However, I maintain that the overall account presented to law enforcement was materially false and created a misleading portrayal of the incident. I further believe that certain statements were knowingly false, while others were made with reckless disregard for their truth or falsity.
I believe these reports were not motivated by genuine concern for my welfare but by retaliation, longstanding rivalry, hostility, and a desire to cause me harm. Immediately before these reports were made, we had been involved in a physical confrontation. They were fully aware of the serious consequences that police involvement and psychiatric hospitalization could have for me because of prior events. Despite that knowledge, they reported the incident in a manner that I believe falsely portrayed me as the aggressor and falsely suggested that I was mentally unwell.
Based upon my lifelong interactions with them, I believe they have harbored longstanding rivalry and hostility toward me. Shortly before the incident, I confronted Aram regarding what I perceived to be three separate instances of jealousy toward my developing romantic relationship with Grace. After I expressed those concerns, the confrontation became physical. I believe the subsequent reports to law enforcement were motivated, at least in part, by retaliation arising from that dispute rather than by a genuine concern for safety.
As a result of these reports, I was hospitalized and subsequently lost my relationship with Grace. I believe these consequences were reasonably foreseeable to those making the reports.I continue to openly express my sincerely held Christian beliefs, including discussing the Bible and my faith. I am concerned that my religious expressions have been inaccurately characterized as evidence of mental illness and used to support false mental health allegations.I respectfully request that investigators determine which statements made to law enforcement were false, which, if any, were knowingly false or made with reckless disregard for the truth, and whether false mental health allegations were used to improperly invoke governmental authority against me. I further request that investigators evaluate the credibility of all statements made by these individuals in light of the physical evidence, witness testimony, and the complete circumstances surrounding the incident.
Aram engaged in simple assault and battery, stood over me within one inch to intimidate me after I accused him of being jealous. Alek aggressively intervened to separate us, then Aram and Alek ganged up on me unnecessarily. This where I got the cuts that bled. And I fled away angrily down the stairs and said, “I can kill you,” because I was angry with how they treated me after taking it easy on them after acting in self defense and releasing Aram after Alek entered the room. Following there was a disputed account of physical altercation between brothers. It was simple assault followed by battery, self defense in response. There were unknowingly false mental health claims made with malintent, and knowingly false criminal claims made with malintent. I acted in self defense, but this was misrepresented, and simple assault and battery ignored. The witness of aggressors were deemed credible after false mental health claims made towards victim. I was the only one injured with blood. They are criminals.
My brothers refuse to discuss the details of the account to this day. They try to cover it up.I declare under the pains and penalties of perjury that the foregoing is true and correct to the best of my knowledge.

I filed a civil case against Winchester Police for handling the situation so poorly over time. The government decided to hear it in Federal Court after removing their immunity. In fact, I did not know what simple assault was until recently, relying rather on Florida law of initial provocations in self defensive acts - shaky grounds yet still bringing me to write an addendum to the report to police within weeks of the incident - practically criminalizing myself. Based on common sense, which I exercised in reporting back then and now, and the law, they are criminals and prison is where they belong. They are truly bad.
Further, it makes sense to cover up a wrong of siblings, which I did at first, however, it does not make sense to cover up a wrong of others when they accuse you of their crime and mental disorder thereafter. The whole scenario is not unprecedented, for look at Barabas' release and Jesus' crucifixion."Barabas! Barabas! Barabas!"
